The Market Place Fairness Impact
For many years, the retailers have been taking advantage of a loophole and not charged sales taxes for online sales. So naturally, brick-and-mortar stores have been complaining about the unfair advantage. And the few months ago, the Senate passed with an overwhelming, bipartisan, majority the Marketplace Fairness Act (MFA) that has provided states the power to enforce sales tax rules on all online sales – even when both the purchaser and seller reside in different states. And that bill is now pending before the House. In parallel to this, last month the U.S. Supreme Court totally refused to hear any request for the arguments against the New York’s so-called Amazon Law, thereby closing the door on appeal, and also effectively granting the Court’s approval of the state laws that will expand the rights of states to enforce their sales taxes on ecommerce transactions.
As the obligation to collect sales tax on online transactions is in existence, undoubtedly the passing of the MFA along with the approval of the Amazon laws will empower states to more aggressively enforce their rules upto a great extent.
